TERMS OF USE

Growth Focus Life Coaching

Effective Date: January 15, 2026

By creating an account or enrolling in any program, you agree to these Terms of Use as in effect on the date of your purchase and account creation.

These Terms of Use constitute a legally binding agreement between you (“Client,” “you,” “your”) and Esther Malky Gordon, Growth Focus Life Coaching (“Coach,” “we,” “us,” “our”).

By creating an account, enrolling in any program, or accessing any content hosted on Thinkific or any affiliated platform, you confirm that you have read, understood, and agreed to these Terms of Use.

1. Nature of Coaching

Coaching is a collaborative process designed to support personal growth, clarity, and goal achievement.

You understand and agree that:

• Coaching is not therapy, counseling, medical treatment, mental health care, legal advice, or financial advice

• You are responsible for your own decisions, actions, and results

• You are emotionally and psychologically capable of participating in a coaching program

If you are experiencing a mental health crisis, please seek support from a licensed professional or emergency services.

2. No Guarantees

You acknowledge that:

• Results are not guaranteed

• Outcomes vary based on individual effort, participation, and circumstances

• Growth Focus Life Coaching makes no promises regarding specific results or outcomes

You accept full responsibility for your progress and decisions.

3. Program Access & Participation

Enrollment grants you limited, personal, non-transferable access to the program content for your own use only.

You agree to:

• Participate honestly and responsibly

• Complete lessons and exercises to the best of your ability

• Attend scheduled coaching calls (if included)

Missed coaching sessions are forfeited unless otherwise stated.

4. Coaching Calls (If Included)

If your program includes live 1:1 coaching calls:

• Calls are scheduled via the booking method provided inside the course

• Sessions start and end on time

• Late arrivals of more than 10 minutes may result in forfeiture of the session

• Rescheduling requires at least 24 hours’ notice unless otherwise stated

Calls are limited to what is explicitly included in your program.

5. Payments & Refund Policy

All prices are clearly disclosed at checkout.

All sales are final. No refunds are offered.
By enrolling, you knowingly waive any right to request or dispute a refund for any reason, including non-use, dissatisfaction, or inability to complete the program.

6. Payment Plans & Access

If you choose a payment plan, you understand and agree that:

• Access to the Program is granted immediately upon receipt of the first payment

• You are committing to complete all payments in the plan

• Payment plans are offered as a convenience and are not a subscription

• Failure to complete a payment does not cancel your financial obligation

• If a payment fails or is declined, we may:

  • Retry the charge automatically, and/or

  • Suspend or revoke access to the Program until payment is resolved

• No refunds or credits will be issued for missed or unused access

By enrolling via a payment plan, you acknowledge that you are entering into a binding financial commitment.

7. Account Security & Unauthorized Use

You are responsible for maintaining the confidentiality of your login credentials.

You may not:

• Share your account or login details

• Allow others to access your account

• Duplicate, distribute, sell, or share any program materials

Unauthorized use may result in immediate termination of access without refund.

8. Intellectual Property

All content provided—including videos, workbooks, audio recordings, written materials, exercises, and frameworks—is the sole intellectual property of Growth Focus Life Coaching.

You are granted a revocable, limited license for personal use only.
No ownership rights are transferred.

Any reproduction, distribution, or commercial use is strictly prohibited.

9. Confidentiality

We respect your privacy and confidentiality. Coaching communications will not be shared except:

• With your written consent

• If required by law

• If there is a risk of harm to yourself or others

10. Limitation of Liability

To the fullest extent permitted by law, Growth Focus Life Coaching shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your participation in the program.

11. Indemnification

You agree to indemnify and hold harmless Growth Focus Life Coaching from any claims, losses, or damages arising from:

• Your misuse of the program

• Your violation of these Terms

• Your actions or decisions resulting from participation

12. Termination

We reserve the right to suspend or terminate access to the Program if these Terms are violated. No refunds will be issued in the event of termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New York, USA, without regard to conflict of law principles.

14. Entire Agreement

These Terms constitute the entire agreement between you and Growth Focus Life Coaching and supersede any prior agreements or understandings.
